Acceptance of these terms
This website, ivyleaguepediatrics.com (the "Site"), is operated by Ivy League Pediatrics, Inc., a Georgia corporation ("Ivy League Pediatrics," "we," "us" or "our"), located at 603 Old Norcross Rd, Ste A, Lawrenceville, GA 30046.
By using the Site you agree to these Terms of Use and to our Privacy Policy, which is part of these terms. If you do not agree, please do not use the Site. You can always reach us by phone at 678-407-4489 instead.
These terms govern the Site only. They do not create, change or limit the relationship between the practice and a patient. That relationship is formed when a child is seen at the practice and is governed by Georgia law, our patient agreements and our Notice of Privacy Practices.
The Site is not medical advice
The Site describes the practice, our clinicians, our services and the insurance we accept, and it includes general information for parents. That information is educational. It is not medical advice, it is not a diagnosis and it is not a substitute for a visit with a clinician who can examine your child.
Reading the Site, registering as a new patient, or sending us a message does not by itself make you or your child a patient of the practice and does not create a physician-patient relationship. That relationship begins when your child is accepted as a patient and seen by one of our clinicians.
Never disregard professional medical advice, or delay seeking it, because of something you read on the Site.
Emergencies
If your child is having an emergency, call 911 or go to the nearest emergency room. Do not use the Site, email or the patient portal to report an emergency. They are not monitored for urgent messages and no one will see them in time.
Signs that mean 911, not the website: trouble breathing, unresponsive or very hard to wake, a seizure, a serious injury, or your own instinct telling you this is an emergency.
Booking and registration
The Site links to two services for booking. Neither is part of the Site, and each has its own terms that apply once you are there.
- New patients register through our form at form.jotform.com. Submitting the form is a request to join the practice, not a confirmed appointment. We will call you to schedule your first visit. Acceptance as a patient is subject to our clinical policies, including our vaccination policy, and to the insurance we accept.
- Existing patients book through the patient portal at ivy.pcc.com. The portal has its own login and terms. You are responsible for keeping your portal login private.
When you use either service you agree to give accurate and complete information, to have the legal authority to register or book for the child concerned, and to tell us if any of that information changes. Times shown in the portal are subject to the practice's schedule and may occasionally need to be moved. We will contact you if so.
Using the Site
You may view the Site and share links to it for personal, non-commercial purposes. You agree not to:
- use the Site for any unlawful purpose or in a way that could harm the practice, our patients or others;
- copy, scrape, harvest or republish content from the Site by automated means beyond what our
robots.txtpermits for search engines; - interfere with the Site's operation or security, or attempt to gain unauthorized access to it or to any connected system, including the patient portal or registration form;
- impersonate the practice, a clinician or another person, or misrepresent your connection to us;
- submit false registration information or book appointments you do not intend to keep; or
- remove or alter any copyright, trademark or other notice on the Site.
We may block access to the Site for anyone who breaks these rules.
Content, photographs and trademarks
The Site and everything on it, including text, page design, graphics and code, is owned by Ivy League Pediatrics or used under license and is protected by copyright and other laws. "Ivy League Pediatrics" and our logo are our trademarks. You may not use them without our written permission.
Photographs. The people in the photographs on the Site are our clinicians, staff and families who agreed to appear here. Those photographs are for this Site only. Do not copy, download or reuse them anywhere else. This matters more than usual because some of them show children.
You may link to the Site, and you may use the sharing buttons we provide. You may not frame the Site or present its content as your own.
Patient reviews
The Site quotes from reviews that families have published on public platforms such as Google. Quotes may be shortened but are not otherwise changed. They reflect the experience of the person who wrote them. They are not a promise about anyone else's experience or outcome, and every child's care is different.
Insurance information
We do our best to keep the list of plans we accept accurate, and we say plainly which plans we do not accept. Insurance contracts change, plan names on cards can differ from the plan itself, and coverage depends on your specific policy. Being listed on the Site is not a guarantee that your plan will cover a particular visit or service. Please confirm with your plan or call us before your visit if you are unsure.
Third-party sites and services
The Site links to services we do not control, including the registration form, the patient portal, Google Maps, Google Search and insurers' websites. We are not responsible for their content, availability, terms or privacy practices. A link is not an endorsement. Those sites' own terms apply when you use them.
Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind about the Site, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. We try to keep the Site accurate and current, but information such as hours, clinicians, services and insurance can change, and we do not guarantee that the Site is free of errors or that any fault will be corrected.
Nothing in this section limits or disclaims any duty we owe to a patient in providing medical care. That duty arises from the clinical relationship, not from the Site, and is not affected by these terms.
Limitation of liability
To the fullest extent permitted by law, Ivy League Pediatrics and its officers, clinicians, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or goodwill, arising out of or relating to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability to you for all claims arising out of or relating to the Site or these terms will not exceed one hundred US dollars ($100).
This section applies to the Site only. It does not limit liability for medical care provided to a patient of the practice, which is governed by Georgia law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing in these terms excludes liability that cannot be excluded by law.
Indemnification
You agree to indemnify and hold harmless Ivy League Pediatrics and its officers, clinicians, employees and agents from any claim, loss or expense, including reasonable attorneys' fees, arising out of your violation of these terms or your misuse of the Site.
Use by minors
The Site is written for parents and guardians. It is not directed at children and has nothing for a child to fill in. Registration and portal booking must be done by a parent or legal guardian, or by a patient who is legally able to consent to their own care. If you are under 18, please use the Site with a parent or guardian.
Privacy
How we handle information collected through the Site is described in our Privacy Policy. How we handle your child's medical information is described in our Notice of Privacy Practices. Both are part of these terms.
Changes to the Site and these terms
We may change, suspend or remove any part of the Site at any time. We may also update these terms. The "Last updated" date at the top shows when the current version took effect. Using the Site after a change means you accept the updated terms. If you do not agree with a change, stop using the Site.
Governing law and disputes
These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. If a dispute arises about the Site or these terms, please contact us first so we can try to resolve it informally. Any claim that cannot be resolved that way must be brought in the state or federal courts located in Gwinnett County, Georgia, and you consent to the jurisdiction of those courts.
This section concerns disputes about the Site. It does not apply to any claim relating to medical care, which is subject to the laws and procedures that govern such claims in Georgia.
General
- Entire agreement. These terms, with the Privacy Policy and the Notice of Privacy Practices, are the entire agreement between you and us about the Site.
- Severability. If any part of these terms is found unenforceable, the rest remains in effect.
- No waiver. Our not enforcing a term is not a waiver of it.
- Assignment. You may not assign these terms. We may assign them to a successor of the practice.
- Headings are for convenience only and do not affect interpretation.
